SoftStep™ Terms of Service
Last Updated: October 17, 2026
OVERVIEW
Welcome to SoftStep™.
The terms “we,” “us,” and “our” refer to SoftStep™ and the legal business operating the SoftStep™ online store.
SoftStep™ operates this website and online store, including the information, content, features, tools, products, and related services made available through it (collectively, the “Services”).
Our online store is hosted and powered by Shopify, which provides the e-commerce platform that enables us to offer and sell our products.
These Terms of Service (“Terms”), together with any policies referenced in them, including our Privacy Policy and Return, Refund & Limited Warranty Policy, govern your access to and use of the Services.
Please read these Terms carefully before using the Services.
By accessing, browsing, purchasing from, or otherwise using the Services, you agree to be bound by these Terms to the extent permitted by applicable law.
If you do not agree with these Terms, you should not use the Services.
Nothing in these Terms is intended to exclude, restrict, or modify any consumer right or remedy that cannot legally be excluded, restricted, or modified under applicable law.
SECTION 1 – ELIGIBILITY, ACCESS AND ACCOUNTS
By using the Services, you represent that you have reached the age of majority in your country, state, or province of residence, or that you have the permission of a parent or legal guardian where legally required.
You may be required to provide personal, shipping, billing, or payment information when using certain Services.
You agree that the information you provide will be accurate, current, complete, and lawfully provided, and that you are authorized to use any payment method submitted.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
You may not sell, transfer, or assign your account to another person without our permission.
SECTION 2 – PRODUCTS, DESCRIPTIONS AND AVAILABILITY
We make reasonable efforts to display our products, descriptions, photographs, measurements, characteristics, and other information accurately.
However, colors and appearance may vary slightly depending on factors such as:
- Screen settings
- Device resolution
- Lighting conditions
- Manufacturing variations that do not materially affect the product
Product descriptions, photographs, advertising statements, and other information will be treated in accordance with applicable consumer law.
Nothing in these Terms allows us to provide products that materially fail to match their description or any legally binding representations made about them.
We may modify, update, discontinue, or limit the availability of products before an order is accepted, subject to applicable law.
Product availability is not guaranteed until your order has been accepted.
SECTION 3 – ORDERS AND CONTRACT FORMATION
When you place an order, you are submitting an offer to purchase the products in your order.
Receiving an automated order acknowledgment does not necessarily mean that we have accepted your order.
Unless applicable law requires otherwise, an order is accepted when we confirm acceptance or dispatch of the order.
If payment has already been collected and we lawfully cancel an order before fulfillment, any amount due back to you will be refunded to the original payment method.
We may refuse or cancel an order for legitimate reasons, including:
- Product unavailability
- Obvious pricing or listing errors
- Suspected fraud or unauthorized payment
- Shipping restrictions
- Legal or regulatory requirements
- A reasonable belief that an order is being placed for unauthorized resale or fraudulent purposes
We will not cancel an accepted order in a manner that violates applicable consumer law.
Purchases are also subject to our Return, Refund & Limited Warranty Policy, which forms part of these Terms.
Unless otherwise agreed by us, products purchased through the store are intended for personal or household use and not unauthorized commercial resale.
SECTION 4 – PRICES, TAXES AND PAYMENTS
Prices are displayed in the currency indicated on the website or at checkout.
Before completing your purchase, you will be shown the applicable price and the shipping charges, taxes, and other charges that we collect where those amounts are required to be disclosed and can be determined.
International orders may be subject to customs duties, import taxes, or other government charges depending on the destination country.
Where such charges are not collected by us, they may be charged separately by the relevant authority or carrier, subject to applicable disclosure requirements.
We will not intentionally impose undisclosed mandatory charges after you complete your purchase where prohibited by law.
You agree to provide valid and authorized payment information.
By submitting payment information, you authorize us and our payment processors to charge the applicable amount for your order.
SECTION 5 – SHIPPING, DELIVERY AND RISK OF LOSS
Delivery dates and shipping times displayed on our website are estimates unless we expressly agree to a guaranteed delivery date.
We will make reasonable efforts to fulfill and deliver orders within the stated timeframe.
Delays may occur because of circumstances such as:
- Carrier delays
- Customs processing
- Severe weather
- Incorrect or incomplete delivery information
- Events outside our reasonable control
Estimated delivery times do not override any mandatory delivery deadlines or other rights provided by applicable consumer law.
For consumer orders, risk of loss or damage generally remains with us until the goods are delivered into your physical possession, or into the possession of a person you have designated to receive them, where applicable law requires this.
If you independently arrange a carrier that we did not offer as a delivery option, different risk-transfer rules may apply where permitted by law.
If an order is lost or damaged before delivery, please contact us at:
Nothing in this section limits your statutory rights concerning lost, damaged, delayed, or undelivered goods.
SECTION 6 – RETURNS, REFUNDS AND WARRANTIES
Returns, refunds, defective products, and our commercial warranty are governed by our separate:
SoftStep™ Return, Refund & Limited Warranty Policy
That policy forms part of these Terms.
Our voluntary return policy and 90-Day Limited Warranty provide additional contractual benefits and do not replace or reduce statutory consumer rights.
Where applicable law provides greater protection than our commercial policies, applicable law will prevail.
SECTION 7 – INTELLECTUAL PROPERTY
Unless otherwise indicated, the content made available through the Services, including:
- Text
- Graphics
- Logos
- Product photography
- Videos
- Website designs
- Branding
- Product names
- Software
- Other original content
is owned by, licensed to, or lawfully used by SoftStep™ and is protected by applicable intellectual property laws.
You are granted a limited, revocable, non-exclusive, and non-transferable right to use the Services for lawful personal purposes.
You may not reproduce, distribute, sell, modify, scrape, commercially exploit, or create unauthorized derivative works from protected content without permission, except where permitted by law.
Nothing in these Terms grants you ownership of SoftStep™ trademarks, branding, copyrighted material, or other intellectual property.
SECTION 8 – THIRD-PARTY SERVICES AND LINKS
The Services may contain links to, integrations with, or functionality provided by third parties.
Third-party services may be governed by their own terms, privacy policies, and practices.
We are not responsible for the independent content, policies, or conduct of third parties that we do not control, except where applicable law provides otherwise.
You should review the applicable terms and policies before using third-party services.
SECTION 9 – SHOPIFY
Our store uses Shopify's e-commerce platform.
Unless clearly stated otherwise, SoftStep™ is the seller of the products purchased from our store, and the purchase relationship is between the customer and SoftStep™.
Shopify provides technology and related services supporting the operation of the store but is not the seller of SoftStep™ products solely by providing that platform.
Nothing in this section changes any rights or obligations that Shopify may separately have under its own services or applicable law.
SECTION 10 – PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable privacy and data-protection laws.
Our Privacy Policy explains, among other things, what information we collect, why we collect it, how it may be used or shared, and what rights may be available to you.
SECTION 11 – REVIEWS, COMMENTS AND USER CONTENT
If you voluntarily submit a review, testimonial, photograph, video, comment, suggestion, or other content to us, you retain any ownership rights you may have in that content.
To the extent permitted by law, you grant SoftStep™ a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that content for legitimate business purposes, including operating, improving, and marketing SoftStep™.
This license applies only to content that you have the legal right to provide.
We will process any personal information associated with such content in accordance with our Privacy Policy and applicable law.
You may not submit content that is unlawful, fraudulent, defamatory, infringing, malicious, or that violates the rights of another person.
SECTION 12 – ERRORS, INACCURACIES AND CORRECTIONS
Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to matters such as product descriptions, pricing, promotions, shipping charges, or availability.
We may correct genuine errors and update information when reasonably necessary and legally permitted.
If we discover an error before accepting an order, we may correct the information and give you the opportunity to proceed under the corrected terms.
If an error is discovered after a binding contract has been formed, we will handle the matter in accordance with applicable contract and consumer law.
We will not use this section to retroactively change an agreed price or material contractual term where doing so is prohibited by law.
SECTION 13 – PROHIBITED USES
You may not use the Services to:
- Violate applicable laws or regulations
- Commit fraud or other unlawful activity
- Infringe intellectual property or privacy rights
- Transmit malicious software or harmful code
- Attempt unauthorized access to our systems
- Interfere with the security or normal operation of the Services
- Impersonate another person
- Provide intentionally false or fraudulent information
- Use automated systems to improperly scrape, disrupt, or exploit the Services
- Engage in abusive or harmful conduct
We may take reasonable action to protect the Services, customers, and our legal rights.
SECTION 14 – SUSPENSION AND TERMINATION
We may suspend or terminate access to the Services where reasonably necessary because of:
- A material violation of these Terms
- Fraudulent activity
- Security threats
- Illegal activity
- Abuse of the Services
Termination does not eliminate rights or obligations that arose before termination.
Nothing in this section limits any rights or remedies you have under applicable consumer law.
SECTION 15 – WARRANTIES AND DISCLAIMERS
Our products are covered by the warranties expressly described in our Return, Refund & Limited Warranty Policy, together with any statutory warranties, guarantees, or consumer rights that apply.
We do not disclaim or exclude implied warranties, statutory guarantees, or other rights where doing so is prohibited by law.
To the maximum extent permitted by law, website functionality and non-product informational features of the Services are provided on an “as available” basis, and temporary interruptions or technical errors may occur.
This provision does not make SoftStep™ products “as is” products and does not remove any express warranty, implied warranty, statutory guarantee, or mandatory consumer protection.
SECTION 16 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms is intended to exclude or limit liability for matters that cannot legally be excluded, including where applicable:
- Fraud or fraudulent misrepresentation
- Willful misconduct
- Death or personal injury where liability cannot legally be excluded
- Mandatory product-liability obligations
- Statutory consumer guarantees
- Other non-waivable consumer rights
To the maximum extent permitted by applicable law, SoftStep™ will not be responsible for indirect, incidental, special, or consequential losses that were not reasonably foreseeable and that do not arise from a violation of a non-waivable legal obligation.
Any limitation of liability will apply only to the extent that it is lawful and enforceable in your jurisdiction.
SECTION 17 – CUSTOMER RESPONSIBILITY FOR UNLAWFUL MISUSE
You are responsible for losses directly caused by your intentional unlawful misuse of the Services or a material violation of these Terms, to the extent permitted by applicable law.
Nothing in this section requires a consumer to indemnify SoftStep™ for SoftStep™'s own negligence, breach of contract, defective products, unlawful conduct, or violation of consumer rights.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where possible.
If that is not possible, the affected provision will be severed.
The remaining provisions will continue in effect to the extent permitted by law.
SECTION 19 – ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Return, Refund & Limited Warranty Policy, and other policies expressly incorporated into them, constitute the agreement governing your use of the Services.
Nothing in this section excludes any representation, disclosure, product description, statutory information, warranty, or other term that applicable law requires to form part of the agreement between us.
SECTION 20 – GOVERNING LAW AND CONSUMER RIGHTS
To the extent permitted by applicable law, these Terms and transactions with SoftStep™ are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles.
However, if you are a consumer residing in another state or country, this choice of law does not deprive you of mandatory consumer protections that apply to you and cannot legally be waived by contract.
Nothing in these Terms prevents you from bringing a claim before a court or other competent authority where applicable law gives you the right to do so.
SECTION 21 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in:
- Our Services
- Our business practices
- Applicable laws or regulations
- Security requirements
The updated version will be posted on our website with a revised “Last Updated” date.
Changes will apply prospectively unless applicable law permits otherwise.
We will not retroactively remove rights that have already arisen under an existing purchase where doing so is prohibited by law.
